Mercy HealthServices ("Mercy") is pleased to offer you access to the online siteknown as MyChart. MyChart provides you access to your health, medical, and insurance information via the internet. Among other things MyChart permits users to view selected portions of their medical records and receive certain laboratory and imaging results. Users are also able to communicate with their health care providers regarding non-urgent health concerns. Use of the MyChart site is optional; however, patients who choose to use MyChart do so subject to the following Terms & Conditions.
ElectronicMessages:
MyChart allows youto communicate directly with your healthcare providers regarding your medicalcare through electronic messages. You should not expect that messages will beresponded to immediately. Accordingly, you agree that you will only use MyChartmessages for communications of a non-urgent, routine nature. When in doubt,contact your healthcare provider by telephone. If you have a medical emergency,you should immediately dial 911 and you should not attempt to communicate withyour healthcare provider through MyChart.
You alsounderstand that your healthcare provider can only respond to the informationyou have provided. If the information you provide via MyChart is incomplete orinaccurate, it will not be possible for Mercy to provide a complete or accurateresponse. Messages sent to you via MyChart may contain information that isimportant to your health and medical care. It is your responsibility to monitorthese messages and take appropriate action in a timely manner. It is also yourresponsibility to follow up with your healthcare provider if you do not receivea response message, as spam and junk mail filters, technical glitches, etc.could prevent transmission of the response.
You also agree tocommunicate through MyChart only for questions related to your own medicalcondition or for the medical condition of someone for whom you are authorizedto make medical decisions. You agree that asking for advice on behalf ofanother person for whom you are not authorized to make medical decisions couldpotentially be harmful and is a violation of these Terms and Conditions of Use.
MyChart electronicmessages may be shared with Mercy healthcare providers assisting in yourmedical care or with staff members directing your message to the appropriatehealthcare provider. Therefore, MyChart may not be appropriate for sensitivematters or issues that you wish to discuss with your healthcare providerdirectly. Messages exchanged between you and your healthcare provider throughMyChart become part of your official medical record. This information isconfidential but may be released with your consent or by legal requirement. Youagree to use appropriate discretion when sending online messages, particularlyif you do not want the information to appear in your permanent medical record.
E-mail Privacy:
As a MyChart user,you will be notified via e-mail when there is new medical information to beviewed in your MyChart account. This means that any person with access to youre-mail will be able to see this notification. You should take this into accountwhen registering an e-mail address with MyChart.
Eligibility:
An individual must be age 13 or older to request a MyChart account. Parents or guardians of minor children ages 12 and under may request creation of and access to a minor child's account by following the terms outlined in the "Proxy Access" section of these Terms and Conditions.
Proxy Access Disclaimer:
Individuals age 18 or older may be granted proxy access to another adult patient’s MyChart account upon the patient’s submission of a MyChart Proxy Access Authorization Form or electronic agreement to the Adult Proxy Access Terms and Conditions of Use. A parent or legal guardian of a minor age 11 and younger may request proxy access to the minor’s MyChart account by submitting a MyChart Child Proxy Request Form, which will provide full access to the minor’s MyChart account. When the patient turns 12, Proxy access will terminate automatically. A parent or legal guardian of a minor between the ages of 12 and 17 may request proxy access to a teen’s MyChart account by submitting a MyChart Teen Proxy Request Form, which requires the signature of both the minor and the parent/legal guardian and must be submitted at an in-person office visit. Proxy access to a teen’s MyChart account will be more limited to protect the teen’s rights to privacy. You understand that MyChart access is a privilege, not a right, and that you must agree to comply with the MyChart Terms and Conditions of Patient Use (the "Terms and Conditions") in order to access a patient’s MyChart account as a Proxy. You acknowledge that access to MyChart is provided by Mercy as a convenience to its patients and families and Mercy may deactivate your Proxy access to MyChart in its discretion. You also understand that a patient may revoke your Proxy access to the patient’s MyChart account at any time and for any reason. If your legal relationship or authority to access the patient’s health information changes, you must inform Mercy immediately and discontinue use of the proxy account.
Security andConfidentiality:
Mercy affords thesame degree of confidentiality to medical information stored on MyChart that isgiven to medical information stored by Mercy in any other medium. Youunderstand, however, that Mercy cannot guarantee the security of the MyChartsystem. In addition, you understand that you are responsible to ensure thatyour computer or other electronic device(s) has protections against viruses,malware, spyware, trojan horses, and other types of computer software orprograms that could compromise the security of your computer or electronicdevice(s). You also understand that you are responsible for selecting a securepassword and maintaining the confidentiality of your password.
Request toAccess Laboratory Test Results:
By requesting a MyChart account, you understand that Mercy will provide you with available laboratory results through your MyChart account. You understand, however, that for legal, health, and/or business reasons, Mercy may not make certain laboratory results available through MyChart.
No Guarantee ofAccess or Completeness of Medical Record:
Mercy cannotguarantee that use of MyChart will be free of interruptions. Routinemaintenance of computer systems, power outages, or other circ*mstances may leadto inaccessibility of MyChart. During these times, if it is necessary tocontact your healthcare provider you should do so by telephone or by anin-person visit. MyChart is designed for your convenience and to enhance youraccess to certain parts of your medical record. However, MyChart does notcontain your complete medical record, and certain information will not appear in your MyChart account.

Appropriate Useand Suspension or Termination of Use of MyChart:
Access to theMyChart system is granted to you for the purpose of furthering your medicalcare. Use of the system unrelated to this purpose may result in the suspensionor termination of access privileges. Improper activities include, but are notlimited to, the use of inappropriate or abusive language, reserving appointmenttimes that are not needed or are frequently cancelled and other activities thatare deemed to cause a disruption to operations. You understand that you have nocontractual or legal entitlement to the use of MyChart and that Mercy mayterminate your access to MyChart for any reason. You may also contact Mercy atany time to request termination of your access to MyChart.
Indemnificationand Other Terms:
Mercy shall not beliable for any damages suffered by you or any other third parties related toyour use of MyChart, whether directly or indirectly. By creating a MyChart account, you agree to hold Mercy harmless and indemnify it against any liability, damages, causes of action, or other claims arising out of, or in any way connected with, your use of MyChart or the information contained therein. The Terms and Conditions of Use may be changed at any time in the discretion of Mercy and updated terms will be posted on the MyChart website for your review. You agree that each time you use MyChart you are, by such use, consenting to the Terms and Conditions applicable at that time. The content of MyChart is protected by copyright. You may access the content of MyChart only for your personal, noncommercial use. If you desire to reproduce or download any part of the content for other than personal use, you mustrequest and receive written permission from Mercy before doing so.
